Summary. PERCH is a marketplace and software platform for factory-built housing. Each Home listing is fulfilled by the Seller of Record named on that product page and in your Purchase Contract — either an independent builder (third-party listings) or PERCH itself (PERCH-branded listings). Every Home must be paid in full before it leaves the factory. Freight, crane set, site installation, and final connections are performed by licensed third parties disclosed at Reservation. PERCH is held harmless for loss, damage, delay, or injury arising during transportation, site installation, or post-delivery use — those risks belong to the freight carrier, installer, contractor, or manufacturer, per their own insurance and warranties. Reservation deposits are refundable up to $925 per Refund Policy §1.1; the Home purchase price is not refundable once production begins. Merchandise ships from Printify. Digital and service products are provisioned instantly at payment.
1. Who fulfills your order
Every Home listing on PERCH names its Seller of Record and Manufacturer of Record on the product page, on your Purchase Contract, and on your invoice.
- Third-party listings. For homes listed by an independent builder, that builder is the Seller of Record and the Manufacturer of Record. PERCH acts as a marketplace facilitator only: PERCH lists the home, collects payment, holds funds through licensed escrow rails, and hands off buyer information to the builder to schedule production, freight, and delivery. PERCH is not the seller, does not take title to the home, and does not build, transport, install, or service the home.
- PERCH-branded listings. Where a listing is offered under a PERCH product label, PERCH is the Seller of Record; the contract manufacturer named on the product page is the Manufacturer of Record. PERCH remains not-a-carrier, not-an-installer, and not-a-contractor for these listings — freight, crane set, and site work are still performed by licensed third parties whose identity, scope, insurance certificates, and warranty terms are disclosed to you in your Purchase Contract before you commit funds beyond your Reservation deposit.
2. Payment before dispatch — no exceptions
Across all listings, third-party and PERCH-branded alike, every unit must be paid in full before it leaves the factory. The payment sequence is governed by your Purchase Contract and the Refund Policy. In practice this means:
- Your Reservation deposit ($1,000) holds your build slot in the queue and secures your build-out configuration. Reservation deposits are refundable up to $925 inside the window described in Refund Policy §1.1; the $75 non-refundable transaction-processing fee is disclosed on the checkout screen and retained by PERCH to cover payment-processor charges that are not returned to PERCH on refund.
- Your pre-production payment triggers material allocation and opens your assigned factory slot with the Manufacturer of Record. Once production begins, the Home purchase price is not refundable in whole or in part — see Refund Policy §1.3.
- Any remaining balance under your Purchase Contract must clear before the manufacturer will release your unit from its yard for dispatch. A unit will not leave the factory on partial payment. This is standard factory-direct practice and is required to protect the Manufacturer of Record's title until you have paid what is owed.
3. Delivery footprint, freight, and timing
Delivery footprint, freight cost, and lead times are listing-specific.
- Delivery footprint. Each product page lists the states or regions the Seller of Record currently ships to. If your delivery address is outside the current footprint, PERCH will inform you before your Reservation is accepted and issue a full refund of the deposit if a workable route cannot be arranged.
- Freight cost. Freight is quoted per listing and disclosed on the product page and at checkout. Some listings include freight to specified states; others quote freight individually at Reservation based on distance, route, permit requirements, and pilot-car needs. No freight, permit, escort, or accessorial charge is added after your Purchase Contract is signed without your written consent.
- Handling and transit windows. Typical ranges are disclosed on each product page: factory handling generally 21–90 days after pre-production payment clears, in-transit generally 3–21 days from dispatch depending on distance and permit routing. Your Purchase Contract will restate the specific windows for your build.
- Dispatch notifications. The Seller of Record will confirm your dispatch date at least 5 business days before the truck leaves the yard, and again 24 hours before arrival. PERCH surfaces these updates in your Buyer Portal.
4. Your obligations before delivery
You are responsible for having your site delivery-ready before the delivery window opens. That includes: legal access to the site (recorded easement or public right-of-way), an access route capable of accommodating an oversized load and any required pilot vehicles, cleared and graded pad or foundation per the manufacturer's specification, all required permits pulled and posted, stubbed utilities where the Purchase Contract calls for them, and any HOA / covenant clearances obtained. Storage fees, redelivery fees, or crane cancellation fees for a site that is not ready are owed to the freight carrier, crane operator, or installer per their published rates and are your responsibility, not PERCH's.
5. Crane set, installation, and site work
Crane set, off-loading, placement, tie-downs, mechanical connections, plumbing, electrical, HVAC, foundation, driveway, septic, well, water-line, propane, and any other site work are performed by licensed third-party contractors, either sourced by you or introduced by PERCH from its vetted network. The scope, insurance certificates, and warranty of every third-party contractor engaged for your build are disclosed to you in advance. PERCH does not perform, supervise, warrant, or insure crane, installation, or site work. Your recourse for any defect, delay, or damage caused by these third parties runs to that contractor and its insurer under the contract and warranty issued directly to you.
6. Damage claims and inspection
Inspect your unit the same day it arrives on site. If you observe visible transit damage — skin, roof, framing, glazing, cabinetry, mechanical, or otherwise — document it with clear timestamped photos before the delivery driver leaves and note it on the bill of lading. Report the damage in writing to hello@ownperch.com within 72 hours of delivery. PERCH will route the claim to the freight carrier (for transit damage), the crane operator (for handling damage during set), the installer (for site-work damage), or the Manufacturer of Record (for factory defect covered by warranty). PERCH facilitates the claim but is not the payer of the claim — the responsible party's insurance or warranty covers approved damage. Damage first reported outside the 72-hour window is significantly harder to substantiate and may be denied by the carrier or manufacturer for that reason alone.
7. Risk of loss and title
Risk of loss on your unit passes to you upon delivery to the freight carrier at the manufacturer's yard for dispatch (“FOB Origin”), which is standard for factory-built housing. Title passes on payment in full per your Purchase Contract. Between dispatch and site arrival, your unit is protected by the freight carrier's cargo insurance and, where required, supplemental in-transit coverage disclosed in your Purchase Contract. Buyer is responsible for placing standard homeowner insurance on the unit effective on or before site arrival.
8. Hold-harmless — transportation, installation, and site work
To the maximum extent permitted by law, you agree that PERCH, its officers, employees, contractors, and affiliates are held harmless from and indemnified against any claim, loss, damage, cost, expense, injury, or liability arising out of or related to: (a) freight transportation of any unit purchased through PERCH; (b) crane set, off-loading, placement, or tie-down of any unit; (c) site preparation, foundation, driveway, septic, well, utility connection, or any other site work; (d) any act, omission, delay, or defect of any freight carrier, crane operator, installer, contractor, sub-contractor, or manufacturer engaged in connection with your build; and (e) any loss or damage occurring after the unit leaves the factory yard. Your remedy for any such claim runs to the responsible third party under its own contract, insurance, and warranty issued to you. Nothing in this Section 8 waives PERCH's own liability for fraud, gross negligence, or willful misconduct in the operation of the marketplace itself, or any liability that cannot be waived by contract under applicable law. Corresponding contract provisions appear in the Terms of Service §7.
9. Merchandise (Printify)
PERCH-branded apparel, drinkware, and printed goods are fabricated on demand by our print partner Printify. Typical timing:
- Production: 2–5 business days after order confirmation.
- Transit: 3–7 business days within the contiguous US.
Damaged-on-arrival or manufacturing-defect items are covered per Refund Policy §3: email hello@ownperch.com within 14 days of delivery with photos, and we will replace the item at no cost or refund it in full if a replacement is unavailable.
10. Digital and service products
Builder Suite subscriptions, one-time add-ons (Featured Homepage, Listing Boost, Patio Digest Email Blast, Video Enable), and PERCH Concierge sessions involve no physical shipping. They are provisioned instantly at payment for subscriptions and self-serve add-ons, or on the scheduled date for Concierge sessions and Email Blast sends. Access details or scheduling instructions arrive by email immediately after checkout.
11. Changes to this policy
PERCH may update this policy from time to time. The version and date at the top of this page reflect the current published version. Material changes affecting an active Reservation or Purchase Contract will be notified to affected buyers by email. Your Purchase Contract governs your specific transaction where it conflicts with anything on this page.
