PERCH is the honest marketplace for modular, manufactured, prefab, ADU, and tiny homes, operated by PERCH, Inc. (“PERCH”, “we”, “us”). This Privacy Policy explains what personal data we collect, why we collect it, how we use it, and the rights you have over it. It applies to ownperch.com, our newsletters (The Perch and any product-specific lists), and all PERCH services.
Short version: we collect your email and a few optional fields so we can send you the newsletter and updates you signed up for. We do not sell or rent your data. You can unsubscribe from any marketing email in one click, and you can ask us to delete your data at any time by emailing hello@ownperch.com.
1. Who we are
PERCH, Inc. is the data controller for the personal data described in this policy. You can contact us at hello@ownperch.com for any privacy-related question, including those covered by the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act (CCPA / CPRA), or any other applicable privacy law.
2. What personal data we collect
- Waitlist & newsletter sign-ups: your email address and, where you provide them, your role (Buyer / Seller / Builder), state, and first name.
- Inquiries and lead forms: your name, email, phone (if you choose to provide it), and the message or fields you submit (for example, ADU builder requests, listing requests, contact-form messages).
- Lead magnets and gated content: your email address and any optional fields you provide to receive a PDF, checklist, or template.
- Comments and user-submitted content: the name or handle, email, and comment body you submit on our content.
- Email engagement: opens, clicks, bounces, and unsubscribes, processed for us by our email service providers (Beehiiv and Resend).
- Site analytics: standard request metadata (IP address, browser type, referrer URL, pages viewed, time spent), used in aggregate for security and traffic measurement. We do not use this data to build advertising profiles.
- Cookies: a small number of strictly necessary first-party cookies for session continuity, plus optional analytics cookies you can decline.
3. Why we collect it (legal bases)
Under GDPR and similar laws, every collection of personal data needs a legal basis. Ours are:
- Consent: for newsletters, marketing emails, lead-magnet delivery, and optional analytics cookies. You give consent by submitting a form or by accepting analytics cookies. You can withdraw consent at any time.
- Contract: for delivering the specific service you requested — for example, routing your ADU inquiry to a verified builder in your state, or sending you the PDF you signed up for.
- Legitimate interests: for site security, fraud prevention, aggregate analytics that do not identify individuals, and replying to direct inquiries you send us. We balance these interests against your privacy rights and will not rely on legitimate interests where your rights override them.
- Legal obligation: for responding to lawful requests from authorities and keeping records required by law.
4. How we use your data
- Send you the newsletter and updates you signed up for.
- Deliver the lead magnet, PDF, or resource you requested.
- Route ADU and builder inquiries to the verified PERCH operator we partner with in your state, only when you submit a lead form.
- Reply to direct messages and contact-form submissions.
- Maintain site security, prevent abuse, and measure aggregate traffic.
- Comply with our legal and tax obligations.
We do not use your personal data to build advertising profiles. We do not engage in automated decision-making or profiling that produces legal or similarly significant effects on you.
5. Marketing and unsubscribe
We will only send you marketing emails — including newsletters — based on your consent. Every marketing email includes a one-click unsubscribe link in the footer. Unsubscribing stops marketing emails immediately. You can also email hello@ownperch.com to opt out or to delete your record entirely, and we will action it without unreasonable delay.
Transactional emails (for example, replies to a contact-form submission you sent us) are not marketing and are not affected by an unsubscribe.
6. Who we share data with
We do not sell or rent your personal data. We share it only with the following categories of recipients, and only as needed to deliver the service you requested or to operate PERCH:
- Verified PERCH operators in your state — only when you submit a builder or ADU inquiry, and only the data necessary for them to respond to you.
- Service providers (data processors) who process data on our behalf under a written data processing agreement:
- Beehiiv — newsletter delivery, list management, and email analytics.
- Resend — transactional email delivery and email analytics.
- Google Firebase (Cloud Firestore, Cloud Functions, Hosting) — application hosting, form submission storage, and serverless processing.
- Stripe — payment processing for purchases (we never see or store your full card number).
- Authorities when we are required to by a lawful order or to protect our legal rights.
7. International data transfers
PERCH is based in the United States and our service providers are located in the United States and other jurisdictions. When we transfer personal data from the European Economic Area, the United Kingdom, or Switzerland to the United States or another country, we rely on lawful transfer mechanisms — typically the European Commission’s Standard Contractual Clauses with our service providers — and we apply supplementary measures where appropriate.
8. How long we keep your data
- Newsletter subscribers: until you unsubscribe or ask us to delete your record. Unsubscribed records are retained on a suppression list (email address only) so we do not re-add you accidentally; you can ask us to remove the suppression record too.
- Lead forms and inquiries: up to 24 months after your last interaction, unless we need to retain longer for a specific lawful reason or a contractual relationship.
- Comments: for as long as the comment is published; on request, we will delete or anonymize.
- Analytics logs: aggregated and de-identified after a short rolling window; raw request logs purged within 90 days.
- Records required by law (for example, tax records) are kept for the statutory retention period.
9. Your privacy rights
Depending on where you live, you have some or all of the following rights:
- Access — request a copy of the personal data we hold about you.
- Correction — ask us to correct inaccurate or incomplete data.
- Erasure (“right to be forgotten”) — ask us to delete your personal data.
- Restriction — ask us to limit how we process your data while a question is being resolved.
- Portability — request your data in a structured, commonly used, machine-readable format.
- Objection — object to processing based on legitimate interests, including any direct marketing.
- Withdraw consent — at any time, with no effect on processing already carried out lawfully.
- Lodge a complaint — with your local data-protection authority. For EU/EEA residents, that is the supervisory authority in your country.
- California residents have the additional rights to know, delete, correct, opt-out of “sales” or “sharing” (we do not sell or share for cross-context behavioral advertising), and to non-discrimination for exercising any of these rights.
To exercise any right, email hello@ownperch.com. We will respond within 30 days (or longer where the law allows, with explanation). We may need to verify your identity before acting.
10. Security
We use industry-standard technical and organizational measures — TLS encryption in transit, encrypted storage at rest with our service providers, access controls, and regular review — to protect your personal data. No system is perfectly secure, and we will notify you and the relevant authority of any qualifying breach as required by law.
11. Children
PERCH is not directed at children under 16, and we do not knowingly collect personal data from children. If you believe a child has provided us data, email hello@ownperch.com and we will delete it.
12. Cookies
We use a small number of strictly necessary first-party cookies for session continuity. We use optional analytics cookies (which you can decline) for aggregate site measurement. We do not use third-party advertising or tracking cookies on ownperch.com.
13. Changes to this policy
We will update this policy when our practices change. Material changes will be noted at the top of this page and, where appropriate, communicated by email. Continued use of PERCH after changes take effect means you accept the updated policy.
